Case No. 9177-XAD                                Miami-Dade County Court
Judge Edward Newman

Defendant charged with DUI w/ Property Damage.  Best &
Associates, P.A.  filed a motion to dismiss based upon the State's
failure to prosecute within the time for speedy trial.  Court agreed
with B&A and dismissed all the charges.

Defendant charged with Driving On A Suspended License.  Best &
Associates, P.A. filed a motion to dismiss based upon the State's
failure to prosecute within the time for speedy trial.  Court agreed
with B&A and dismissed  the charges.

Defendant charged with DUI w/ Accident.  Due to evidentiary

Defendant charged with DUI w/ Accident.  All charges were

Judge S. McWhourter

Defendant charged with DUI.  Best & Associates, P.A. filed a
motion to dismiss  the charge based on the fact that the defendant
was asked to give a blood sample by the arresting officers.  The
Court agreed and dismissed the charges.

Judge L. Kreiger-Martin

Defendant charged with driving with a suspended license.  Best &
Associates argued  that defendant's license never should have
been suspended at the time he was pulled over.   On the date of
trial all charges were dropped.

Judge Karen Mills-Francis

Defendant was charged with a DUI while driving erratically on
Florida's turnpike. Defendant was asked to perform numerous
field sobriety exercises which she was deemed to have failed.  
At trial Best & Associates argued that defendant had not been
brought to trial within the proper time limits.  

Outcome: Best & Associates' argument prevailed and the Court
dismissed the case.

Case No. 489974-X                                Miami-Dade County Court
Judge Maria Ortiz

Defendant was charged with DUI on Miami Beach.  As is typical in
all DUI cases, Defendant failed the roadside exercises.  
Defendant took the breathalyzer test and blew one and a half
times over the legal limit (0.131).  

Outcome:  On trial day all charges were dropped and the case was
dismissed.

Case No:  F07-02000892                      Miami-Dade Circuit Court
Judge Bertila Soto

Defendant was charged with felony DUI for driving his
motorcycle while impaired on South Beach.  Best & Associates
argued numerous motions based on constitutional violations
and improper police procedure in the arrest of the defendant.  

Outcome:  Best & Associates prevailed and all charges against
the defendant were dismissed.

Case No.: 1822, -21, 23; 24-FFH        Miami-Dade County Court
Judge Ada Pozo Revilla

Defendant was cited with being under 21 and having an unlawful
beath alcohol content, willful and wanton reckless driving, failure
to carry a driver's license, violation to license restriction, and
failure to use care with regards to pedestrians.
Best & Associates took the case.  

Outcome: On trial day all charges were dismissed.

Judge Antonio Arzola

Defendant was arrested on South Beach for suspected DUI.  
Defendant failed the roadside exercises and gave a breath
sample that registered over twice the legal limit.
Best & Associates took the case.  We filed numerous motions
attacking the actions of the arresting officer and the validity of the
breath test.

Outcome:  On the day of trial all charges against the Defendant were
dismissed.

Case No.: 381687-W                                Miami-Dade County Court
Judge Luise Krieger-Martin

Defendant was arrested by Officer Richard Closius and charged with DUI,
Open Container, and Speeding. Defendant also refused to take the
intoxilyzer (breath) test. Defendant retained Best & Associates who fought
the case at trial.  

Outcome:  After a twenty minute deliberation, the jury returned a verdict of
NOT GUILTY!

Case No. 411236-X                                 Miami-Dade County Court
Judge Luise Krieger-Martin

Defendant was charged with DUI, failure to maintain a single lane, and speeding through a
stop sign.  Officer Richard Closius of the Miami-Dade DUI Task Force made the arrest
and subjected the Defendant to roadside exercises, which he determined Defendant failed
significantly.  At trial Best & Associates proved that these roadside tests are designed for
failure and are not credible evidence to support a conviction.  Best & Associates also put on
various witnesses to contradict Officer Closius' testimony.  

Outcome:  After a fifteen minute deliberation the jury returned a verdict of
NOT GUILTY!
