Defendant was charged with running a red light and DUI stemming
from a Christmas morning arrest. He was deemed to have failed the
roadside exercises and was arrested. Prior to trial Best & Associates
argued that the police investigation was faulty and that the wording of
the arrest affidavit was made to sound worse than the client actually
did in real life. Best & Associates exposed the officer's inexperience
with performing the field sobriety exercises and the Judge dismissed
the case before even getting to the jury.
Outcome: Case Dismissed

Case No.: F07020840 Miami-Dade Circuit Court
Judge Orlando Prescott
Defendant was charged with DUI Homicide/Manslaughter after the
vehicle he was riding in collided with a telephone pole, causing one
of the occupants to be thrown from the vehicle and ultimately pass
away as a result. Police observed defendant act unusual at the
scene and smelled strongly of alcohol. The defendant was charged
and was facing 12 to 30 years in state prison.
Best & Associates took the case and underwent extensive discovery
to determine who was driving the vehicle at the time of the crash by
examining the vehicle, autopsy reports, and deposing all the traffic
homicide officers and medical personnel. Through Best &
Associates' hard work, persistence, and diligence in this case they
were able to show the State of Florida that the defendant may not
have been the driver of the vehicle when it crashed.
Outcome: The State of Florida nol prossed the case, dismissing all
charges against the defendant.

Defendant was arrested by Officer Richard Closius and charged with
DUI,
Open Container, and Speeding. Defendant also refused to take the
intoxilyzer (breath) test. Defendant retained Best & Associates who
fought
the case at trial.
Outcome: After a twenty minute deliberation, the jury returned a
verdict of NOT GUILTY!

Judge Luise Krieger-Martin
Defendant was charged with DUI, failure to maintain a single lane,
and speeding through a stop sign. Officer Richard Closius of the
Miami-Dade DUI Task Force made the arrest and subjected the
Defendant to roadside exercises, which he determined Defendant
failed significantly. At trial Best & Associates proved that these
roadside tests are designed for failure and are not credible evidence
to support a conviction. Best & Associates also put on various
witnesses to contradict Officer Closius' testimony.
Outcome: After a fifteen minute deliberation the jury returned a
verdict of NOT GUILTY!
